Introduction

These Terms of Service (the "Terms") establish the legal relationship between 2lun.com ("2lun", "we", "us", or "our") and all customers, passengers, and users (collectively, "Customers" or "you") for whom we arrange, coordinate, or facilitate private aviation travel through our network of aircraft operators (the "Operators").

Important Notice - Please Read Carefully:

  • • These Terms do not constitute a contract of carriage between you and 2lun.com
  • • All air travel is exclusively governed by the aircraft Operator's Contract of Carriage
  • • 2lun.com is an aviation charter broker, not an aircraft operator or air carrier
  • • 2lun.com assumes no liability for aircraft operations, safety, or flight execution
  • • We reserve the right to modify these Terms at any time; bookings are subject to the version in effect at the time of your request

By using our services, submitting a booking request, or purchasing a membership, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1. General Provisions

Platform services and customer responsibilities

1.1 Platform and Brokerage Services

2lun.com operates a digital platform (website, mobile applications, telephone, and email) that connects customers with licensed aircraft operators. We facilitate the arrangement and booking of private charter flights but do not own, operate, or maintain any aircraft. All flights are performed by independent, certified operators.

1.2 Operator's Terms Govern Air Travel

All aspects of air travel, including but not limited to flight operations, safety protocols, passenger conduct, baggage handling, and liability, are exclusively governed by the Operator's Contract of Carriage and applicable aviation regulations. In the event of any conflict between these Terms and the Operator's terms, the Operator's terms shall prevail with respect to the actual flight services.

1.3 Limitation of 2lun's Role

2lun.com is not responsible for and expressly disclaims any liability related to:

  • Aircraft ownership, maintenance, inspection, or airworthiness
  • Flight crew licensing, training, or performance
  • Flight operations, navigation, or safety procedures
  • Aircraft mechanical failures or technical issues
  • Weather-related delays or cancellations
  • Airport operations or ground handling services

1.4 Customer and Passenger Obligations

Customers must comply with all requirements established by the Operator and applicable regulations, including:

  • Arriving at the designated airport or FBO at the time specified by the Operator
  • Adhering to baggage weight and size limitations
  • Providing valid government-issued identification and travel documents
  • Complying with customs and immigration requirements
  • Following crew instructions and safety protocols
  • Maintaining appropriate conduct throughout the travel experience

1.4.1 Missed Flights and No-Shows

2lun.com bears no liability if a customer or passenger misses their scheduled departure, fails to meet the Operator's check-in requirements, or does not possess required travel documentation. No refunds will be issued for missed flights unless explicitly provided under the Operator's cancellation policy.

1.4.2 Travel Documents and Entry Requirements

Customers are solely responsible for securing and maintaining valid passports, visas, health certificates, and any other documentation required for international or domestic travel. Entry into any country is not guaranteed, even with apparently valid travel documents. 2lun.com provides no guarantees regarding immigration or customs approval and assumes no responsibility for denied entry or deportation.

1.4.3 Compliance with Laws and Regulations

Customers and passengers must comply with all applicable federal, state, local, and international laws and regulations. Any advice or information provided by 2lun.com regarding travel requirements is for informational purposes only and should not be relied upon as legal or definitive guidance. We recommend consulting official government sources and legal counsel for travel requirements.

1.5 Prohibited Conduct - Smoking

Smoking of any kind (including cigarettes, cigars, vaping devices, and electronic cigarettes) is strictly prohibited on all aircraft. Customers who violate this policy agree to indemnify and hold harmless 2lun.com and the Operator for any fines, penalties, cleaning fees, or damages resulting from such violation.

1.6 Responsibility for Group Bookings

When a customer books travel for multiple passengers, that customer assumes full responsibility and liability for all passengers in their party. The booking customer must ensure that all passengers acknowledge, understand, and agree to comply with these Terms and the Operator's Contract of Carriage.

1.7 Baggage Restrictions

Customers must adhere to baggage weight and size limitations established by the Operator and posted on our platform. Excess baggage may result in additional fees or the requirement to ship items separately. Prohibited items include but are not limited to weapons, explosives, flammable materials, and illegal substances as defined by applicable law and TSA regulations.

1.8 Right to Refuse Service

2lun.com reserves the right to refuse service, cancel bookings, or terminate customer relationships at our sole discretion, including but not limited to cases involving payment disputes, policy violations, abusive behavior toward staff or operators, fraudulent activity, or any conduct we deem inappropriate or detrimental to our business operations.

1.9 Itinerary Modifications and Notifications

While we make reasonable efforts to notify customers of schedule changes, delays, cancellations, or other itinerary modifications, 2lun.com assumes no liability for failure to provide such notifications. Customers are responsible for monitoring their bookings and should provide accurate contact information for all communications.

1.10 No Refunds for Missed Travel

No refunds, credits, or compensation will be provided for travel that customers fail to complete due to their own actions or inactions, unless explicitly covered under the Operator's specific cancellation and refund policies.

1.11 Alternative Transportation Arrangements

In the event of flight cancellations or disruptions, 2lun.com may assist in arranging alternative transportation. However, we assume no financial obligation for such arrangements and cannot guarantee the availability or pricing of alternative flights. Any additional costs incurred are the customer's responsibility unless otherwise agreed in writing.

1.12 Operator Insolvency or Legal Issues

If an Operator becomes insolvent, has their operating certificate suspended or revoked, or is otherwise unable to fulfill travel obligations due to legal or financial issues, 2lun.com will make reasonable commercial efforts to arrange alternative transportation through another operator. However, we make no guarantees and assume no liability for such situations.

2. Membership and Service Access

VIP membership benefits and responsibilities

2.1 Charter Flight Requests

Members and customers may submit charter flight requests through our platform. Upon receiving a request, 2lun.com will solicit quotes from qualified operators in our network. Quote availability and pricing are subject to operator discretion and real-time aircraft availability.

2.2 Membership Fee Structure

VIP membership fees, where applicable, provide access to our platform services, priority support, and exclusive benefits. Membership fees are separate from and do not include the cost of actual flight bookings. All fees are non-refundable unless explicitly stated otherwise in your membership agreement.

2.3 Concierge and Support Services

Members may have access to dedicated flight coordinators, concierge services, and priority customer support based on their membership level. Service availability and response times may vary depending on membership tier and request volume.

2.4 Payment Processing

All payments for flights booked through 2lun.com must be processed directly through our platform using approved payment methods. Direct payments to operators or third parties are not permitted and may result in loss of service protections and membership privileges.

2.5 Trust Account Arrangements

Flight payments may be held in a trust account on behalf of the operator until flight completion. This arrangement provides additional security for your transaction while ensuring operators receive timely compensation for services rendered.

2.6 Accuracy of Booking Information

Customers are solely responsible for the accuracy and completeness of all information provided in flight requests, including passenger names, departure/arrival locations, dates, times, special requirements, and passenger counts. Errors in booking information may result in additional fees, flight modifications, or cancellations.

2.7 Quote Review and Confirmation

Before confirming any booking, customers must carefully review the operator's quote to ensure it accurately reflects their requested itinerary, including all dates, times, airports, passenger count, and pricing. Once confirmed, modifications may incur additional fees or may not be possible.

3. Limitation of Liability and Indemnification

Important legal disclaimers and customer obligations

3.1 Flight Cancellations and Schedule Changes

Customers may only seek compensation, refunds, or other remedies from the aircraft operator for flight cancellations, delays, schedule modifications, or service failures. 2lun.com's role is limited to facilitating communication and assisting with rebooking efforts where commercially reasonable.

3.2 Force Majeure Events

2lun.com is not liable for any failure or delay in performance resulting from events beyond our reasonable control, including but not limited to:

  • Acts of God, natural disasters, severe weather conditions
  • War, terrorism, civil unrest, or government actions
  • Pandemics, epidemics, or public health emergencies
  • Labor disputes, strikes, or work stoppages
  • Telecommunications or internet service disruptions
  • Regulatory changes or airspace restrictions

3.3 Passenger Conduct Indemnification

Customers agree to indemnify, defend, and hold harmless 2lun.com, its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from the conduct, actions, or omissions of passengers in their booking party, including but not limited to property damage, personal injury, or regulatory violations.

3.4 Terms Violation Indemnification

Customers and passengers agree to indemnify 2lun.com for any losses, damages, fines, penalties, or legal expenses resulting from violations of these Terms, the Operator's terms, or applicable laws and regulations.

3.5 Operator's Contract Governs Carriage

All aspects of air carriage are exclusively governed by the Operator's Contract of Carriage, which may limit liability for delays, baggage loss, personal injury, or death in accordance with applicable aviation law and international conventions (such as the Montreal Convention or Warsaw Convention where applicable).

3.6 Third-Party Booking Agent Errors

If you book through an authorized travel agent or third-party intermediary, 2lun.com assumes no liability for errors, omissions, or miscommunications made by such third parties. Your recourse for agent-related issues is with the agent directly.

3.7 Independent Contractor Relationship

All aircraft operators in our network are independent contractors. They are not employees, agents, or representatives of 2lun.com. We do not control their operations and are not responsible for their acts, omissions, negligence, or violations of law.

3.8 No Liability for Operator Performance

2lun.com expressly disclaims all liability for operator delays, aircraft substitutions, mechanical failures, crew issues, service quality, or any other aspect of flight operations. Your remedies for such issues are limited to those provided in the Operator's Contract of Carriage and applicable aviation regulations.

3.9 Maximum Liability Cap

To the maximum extent permitted by law, 2lun.com's total aggregate liability to any customer for any and all claims arising out of or relating to these Terms or our services shall not exceed the total fees actually paid by that customer to 2lun.com (excluding amounts paid to operators for flight costs) during the twelve (12) months preceding the claim.

Disclaimer of Warranties

2lun.com provides its platform and services on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our services will be uninterrupted, error-free, or secure.

4. Payment Terms and Conditions

Billing, fees, and refund policies

4.1 Membership and Service Fees

Where applicable, customers may select a membership tier and pay recurring fees for enhanced platform access, priority services, and exclusive benefits. Membership fees provide access to services and features; they do not include the cost of actual flight bookings.

4.2 Direct Payment Requirement

All payments for flights, services, and fees must be made directly to 2lun.com through our approved payment processing systems. We do not authorize direct payments to operators or third parties for services booked through our platform.

4.3 Currency and Pricing

All prices, quotes, and invoices are denominated in United States Dollars (USD) unless otherwise specified in writing. Prices are subject to change based on fuel costs, airport fees, taxes, and other variables. Final pricing is confirmed at the time of booking.

4.4 Non-Refundable Fees

Membership fees, booking fees, service charges, and platform access fees are non-refundable under all circumstances, including but not limited to account cancellation, flight cancellations, service dissatisfaction, or failure to utilize purchased services.

4.5 Accepted Payment Methods

2lun.com accepts the following payment methods:

  • Major credit cards (Visa, MasterCard, American Express)
  • Wire transfers (bank fees are customer's responsibility)
  • ACH transfers (where available)
  • Cryptocurrency (Bitcoin, subject to conversion fees and volatility risk)

All transaction fees, currency conversion fees, and processing charges are the customer's responsibility.

4.6 Trust Account Arrangement

2lun.com may act as a trustee or escrow agent for flight payments, holding funds on behalf of operators until flight services are completed. This arrangement provides transaction security and dispute resolution capabilities while ensuring operators receive appropriate compensation.

4.7 Flight Cancellation Refunds

Refunds for cancelled flights are governed exclusively by the aircraft Operator's cancellation and refund policy. Any applicable refunds will be processed minus all transaction fees, processing charges, and non-refundable service fees. Refund processing may take 10-30 business days depending on the payment method and operator's policies.

4.8 Payment Disbursement

Funds collected for flight bookings are disbursed to operators according to their payment terms and our agreements with them. Typically, payments are released upon flight completion or according to milestone-based payment schedules.

4.9 Late Payments and Collections

Late or failed payments may result in booking cancellation, service suspension, late fees, interest charges, and potential referral to collections agencies. You agree to reimburse 2lun.com for all costs incurred in collecting delinquent amounts, including reasonable attorneys' fees.

5. General Legal Provisions

Contract terms and conditions

5.1 Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you enter into with 2lun.com, constitute the complete and exclusive agreement between you and 2lun.com regarding your use of our services, superseding all prior or contemporaneous communications, proposals, or agreements.

5.2 No Waiver of Rights

Our failure to enforce any provision of these Terms or to exercise any right shall not constitute a waiver of that provision or right. No waiver shall be effective unless made in writing and signed by an authorized representative of 2lun.com.

5.3 No Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Any attempted assignment in violation of this section shall be void. 2lun.com may freely assign these Terms and all rights and obligations hereunder.

5.4 Amendments and Modifications

2lun.com reserves the right to modify these Terms at any time. Material changes will be communicated through email or prominent website notice. Continued use of our services after changes become effective constitutes acceptance. Modifications can only be made by 2lun.com in writing; no customer or employee statements can alter these Terms.

5.5 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

5.6 Survival

Sections relating to payment obligations, liability limitations, indemnification, proprietary rights, and dispute resolution shall survive termination of these Terms or your relationship with 2lun.com.

6. User-Generated Content

Reviews, photos, and media submissions

Users may submit reviews, testimonials, photographs, videos, or other content ("User Content") through our platform. By submitting User Content, you grant 2lun.com a perpetual, worldwide, royalty-free, non-exclusive, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media formats and through any channels.

Content Rights and Warranties

By submitting User Content, you represent and warrant that:

  • You own all rights to the content or have obtained all necessary permissions
  • The content does not violate any third-party rights (copyright, trademark, privacy, publicity, etc.)
  • The content does not contain defamatory, obscene, or illegal material
  • You have obtained all necessary consents from identifiable individuals depicted in photos or videos
  • The content complies with all applicable laws and regulations

Content Moderation and Removal

2lun.com reserves the right to review, edit, refuse, or remove any User Content at any time for any reason without notice or liability. Terminating your account may limit future use of your content but does not eliminate our rights to content previously submitted while your account was active.

Account Deletion

To delete your account and associated data, please contact us at [email protected]. Account deletion does not automatically remove all User Content from our systems, as some content may be retained for legal or operational purposes.

7. Governing Law and Dispute Resolution

Legal jurisdiction and dispute procedures

7.1 Governing Law

These Terms and any disputes arising out of or related to these Terms or our services shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.

7.2 Jurisdiction and Venue

Any legal action, suit, or proceeding arising out of or relating to these Terms or our services must be brought exclusively in the federal or state courts located in Delaware, United States. You irrevocably consent to the jurisdiction of such courts and waive any objection to venue in such courts.

7.3 Informal Dispute Resolution

Before initiating any formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We commit to working in good faith to reach a mutually acceptable resolution.

7.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.

7.5 Time Limitation on Claims

Any claim or cause of action arising out of or related to these Terms or our services must be filed within one (1) year after the claim or cause of action arose, or be forever barred.
